Art. A - General Rules

1. The customer or user browsing in this area accesses www.acetaiaangelo.it, accessible through the url: https://www.acetaiaangelo.it/. The navigation and transmission of a purchase order on the site imply the acceptance and approval of the Conditions and Policies of Data Protection adopted by the site itself indicated therein.

2. These General Terms and Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree no. 206/05 amended by Legislative Decree no. 21/14 and Legislative Decree 70/03) by:

   4. The customer or user are required, before accessing the products provided by the site, to read these General Terms and Conditions of Sale which are generally and unequivocally accepted at the time of purchase.

Art. B - Object of these General Terms and Conditions of Sale

1. These General Terms and Conditions of Sale govern the offer, forwarding and acceptance of purchase orders for products on www.acetaiaangelo.it and do not govern, on the other hand, the provision of services or the sale of products by parties other than the seller who are present on the same site through links banners or other hyperlinks.

2. Before placing orders and purchasing products and services from different parties, we suggest that the buyer checks the conditions of sale.

 

Art. C - Conclusion of the purchase contract

1. In order to conclude the purchase contract, it will be necessary to fill in the form in electronic format and send it according to the relevant instructions.

2. It contains a reference to the General Terms and Conditions of Sale, images of each product and its price, the means of payment that may be used, the method of delivery of products purchased and the related costs of shipping and delivery, a reference to the conditions for exercising the right of withdrawal, method and timing of return of products purchased.

3. Before concluding the contract, the buyer is asked to confirm that it has read the General Terms and Conditions of Sale including the information on the right of withdrawal and the processing of personal data.

4. The contract is concluded when the seller receives the form filled in by the buyer, after verifying the correctness of the data contained therein.

5. The buyer will be obliged to pay the price from the moment in which the procedure for placing the order "online" is concluded. This will be done by clicking on the “Confirm” button at the end of the wizard.

6. Once the contract is concluded, the seller takes charge of the order for its processing and execution.

 

Art. D - Availability of products on www.acetaiaangelo.it

1. The availability of products refers to the actual availability at the time the buyer places the order. This availability shall however be considered purely indicative because, as a result of the simultaneous presence on the site of multiple users and customers, the products may be sold to other customers before the order confirmation.

2. Even after sending the email order confirmation may occur cases of partial or total unavailability of the goods. In this case, the order will be automatically corrected with the elimination of the unavailable product and the buyer will be immediately informed by email.

 

Art. E - Products offered on www.acetaiaangelo.it

1. All products of Acetaia Angelo for the online purchase are available on www.acetaiaangelo.it. For requests of products not on the website please write an email to info@acetaiaangelo.it or call or send SMS / Whatsapp to the mobile phone number +39 3889223004.

 

Art. F - Methods of payment and prices

1. The price of the products will be as indicated and displayed from time to time on the site, unless there is a manifest error.

2. In case of error Acetaia Angelo will notify the buyer as soon as possible allowing the order confirmation at the right amount or cancellation. There will be no obligation for Acetaia Angelo to provide what sold at the lower price incorrectly indicated.

3. The prices of the site are inclusive of VAT and do not include shipping costs. Prices are subject to change at any time and without notice. The changes shall not concern orders for which an order confirmation has already been sent.

4. Once the buyer has selected the desired products, they will be added to the cart. The buyer shall simply follow the purchase instructions, entering or verifying the required information at each step of the process. Order details may be changed before payment.

5. Payment can be made by: Bank transfer, Paypal, Credit Card.

 

Art. G - Delivery of purchased products

1. Acetaia Angelo carries out shipments throughout the Italian territory, excluding the Vatican State and the Republic of San Marino.

2. Acetaia Angelo also ships abroad, for shipments abroad the buyer shall contact by email or phone the company to know the related costs and timing.

3. Acetaia Angelo will deliver to the buyer's home, provided at the time of purchase.

4. The delivery is normally made within 4 days, or, if no delivery date is specified, within the period estimated at the time of selection of the mode of delivery and, in any case, within 30 days from the date of confirmation.

5. Shipping costs are the responsibility of the buyer and are highlighted explicitly at the time of order.

 

Art. H - Transfer of risk from seller to buyer

1. The risks relating to the products shall be borne by the purchaser from the time of delivery. Ownership of the products is deemed to have been acquired upon receipt of full payment of all amounts due in relation to them, including shipping costs, or at the time of delivery, if this were to occur at a later date.

 

Art. I - Warranty and commercial conformity

1. The seller is responsible for any defect in the products on the site, including the non-conformity of the articles with the products ordered, in accordance with the provisions of Italian law.

2. If the buyer has entered into the contract as a consumer or any natural person acting on the site for purposes unrelated to the business or professional activity, this warranty is valid on condition that the defect occurs within 24 months of the date of delivery of the products, that the buyer makes a formal complaint regarding defects within a maximum of 2 months from the date on which the defect was recognized by the latter; that the online return form is completed correctly.

3. In the event of non-conformity, the buyer who entered into the contract as a consumer will be entitled to obtain the restoration of the quality of the products without charge, by repair or replacement, or to obtain an appropriate reduction in price or termination of the contract in relation to the disputed goods and the consequent refund of the price.

 

Art. L - Withdrawal

1. For health and consumer protection the right of withdrawal does not apply because the services and products of Acetaia Angelo are included in the categories of art. 59 of Legislative Decree 206/2005, the Consumer Code.

2. In accordance with the legal provisions in force, and as stated in art. 59 of Legislative Decree 206/2005 of the Consumer Code, chapter 1 letter E, it is impossible for Acetaia Angelo to implement the right of withdrawal as the company is responsible for providing customers with sealed goods that do not lend themselves to be returned for hygienic reasons or related to health protection if they were opened after delivery.

 

Art. M - Data processing

1. The buyer's data are processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the appropriate section containing the information pursuant to art. 13 of Legislative Decree no. 30 June 2003 and art. 13 of EU Regulation 2016/679 (Privacy Policy).

 

Art. N - Safeguard clause

1. Should one of the clauses of these General Terms and Conditions of Sale be null and void for any reason whatsoever, this shall in no case compromise the validity of and compliance with the other provisions contained in these General Terms and Conditions of Sale.

Art. P - Allergens

1. Information on substances that cause allergies or intolerances is available from service personnel. Acetaia Angelo is always available to provide its customers with this information and to give clarifications in case of questions from the users of the site.

 

Art. Q - Applicable law and jurisdiction

1. These General Terms and Conditions of Sale shall be governed by and construed in accordance with Italian law, without prejudice to any other mandatory rule prevailing in the country of the buyer's habitual residence. Consequently, the interpretation, execution and termination of the General Terms and Conditions of Sale are subject exclusively to Italian law.

2. Any disputes concerning and/or resulting from the same shall be resolved exclusively by the Italian judicial authority. In particular, if the buyer qualifies as a Consumer, any disputes shall be resolved by the court of the place of domicile or residence of the same according to the applicable law.
